Terms of Use and Sale

1. Who we are

shlomiamsalem.co.il is the personal website and online store of documentary and official photographer Shlomi Amsalem, business no. 059844639, also trading under the Hebrew name "א.שלומי צילום והפקות" (A. Shlomi Photography and Productions). In these terms, "we" and "the seller" mean Shlomi Amsalem. The store sells the photo book "On the Seventh Day / וּבַיּוֹם הַשְּׁבִיעִי", which documents October 7, 2023 and its aftermath.

2. Scope

These terms apply to the use of the site and to every purchase made on it. The site's Shipping, Cancellation and Privacy Policies form part of them, and placing an order means accepting them. These terms are published in Hebrew and English; if the two conflict, the Hebrew version prevails.

3. Ordering and when an order becomes binding

To order, fill in your name, contact details and shipping address, optionally add notes and a personal dedication, and choose a delivery method. You are then redirected to Cardcom's secure payment page.

An order becomes binding once payment is approved, and an order confirmation is then sent to the email address you provided.

If, after payment is approved, we cannot fulfil the order, for example because the book is out of stock, we will let you know and refund the full amount paid.

4. Prices

Prices are in Israeli new shekels (ILS) and are final prices to pay. As of the date of these terms, the book costs ILS 249. Delivery charges, if any, are shown separately on the order page before payment. The binding price is the one displayed when the order is placed.

If a price contains an obvious error, we will contact you, and you may choose either to complete the order at the correct price or to cancel it for a full refund.

5. Payment via Cardcom

Payment is made by credit card, in a single payment only, on the secure hosted payment page of Cardcom Ltd., which operates under the PCI-DSS security standard. Card details are entered only with Cardcom; the site never sees or stores them. A receipt or invoice, as applicable, is issued separately by the seller.

6. Personal dedication

At checkout you may request a personal dedication of up to 40 characters. It will be written exactly as submitted, so please check the wording before paying. We may decline to write a dedication that is offensive or unlawful; in that case we will contact you, and if no alternative wording is agreed, the order will be cancelled and fully refunded. For cancelling an order that includes a dedication, see section 8.

7. Delivery

We deliver within Israel only, by self-pickup by appointment, collection from a pickup point, or courier to your door. Delivery charges and estimated delivery times are shown on the order page before payment and appear in the order confirmation. See our Shipping Policy for details.

International shipping is not currently available; please contact us to ask about a personal arrangement.

8. Cancellation

Under section 14C of the Israeli Consumer Protection Law, 5741-1981, you may cancel the transaction from the date it is made until 14 days after receiving the book or the disclosure document setting out the transaction details, whichever is later. Notice of cancellation may be given by phone, by email, in writing using the details on the contact page, or through the "Cancel a transaction" link on the homepage. The notice must state your name and ID number; please also include your order number.

Where cancellation is due to a defect, a mismatch with the details provided, failure to deliver by the set date or any other breach on our part, no cancellation fee is charged and the full amount paid is refunded within 14 days of our receiving the notice (see section 9).

Where you cancel for any other reason, the amount paid is refunded to the original payment method within 14 days of our receiving the notice, less a cancellation fee of 5% of the price of the book or ILS 100, whichever is lower. The book is to be returned to the seller by prior arrangement. If its value has fallen as a result of a significant deterioration in its condition, the seller reserves the right to claim damages under the law.

A book bearing a personal dedication written at your request may be considered goods made specifically for the consumer following the transaction, to which the statutory right of cancellation does not apply under section 14C(d)(4) of the Law. Once the dedication has been written, the order may therefore not be cancellable, except on grounds of a defect, mismatch, late delivery or other breach. Until the dedication is written, the usual cancellation terms apply.

A consumer who is a person with a disability, a senior citizen or a new immigrant, as defined in section 14C1 of the Law, may cancel within four months of the transaction, of receiving the book or of receiving the disclosure document, whichever is later, provided the transaction involved a conversation between the seller and the consumer. The seller may ask to see a certificate confirming eligibility.

9. Defective items

If the book arrives defective, damaged in transit or not as ordered, please contact us promptly, ideally with a photo. You may cancel the transaction and receive a full refund of the amount paid, including delivery charges, with no cancellation fee; the book is to be made available to us where it was delivered, and we will arrange its collection. Alternatively, at your choice and subject to stock, we will replace it with an undamaged copy.

10. Institutional orders

Governments, embassies, organisations and institutions wishing to place bulk orders should contact us through the contact form and choose the institutional orders topic. These orders are handled manually against a purchase order and invoice. Commercial terms, including price, quantity, delivery dates and cancellation terms, will be set in the quotation or purchase order, and these terms apply to any matter not covered there. Cancellation rights under the Consumer Protection Law apply to buyers who are consumers as defined in that Law.

11. Intellectual property

All photographs and texts on the site and in the book are protected by copyright and belong to Shlomi Amsalem, unless stated otherwise. They may not be copied, distributed, published or altered, or used commercially, without prior written permission, except as permitted by law. Buying the book does not grant any rights in the photographs.

12. Limitation of liability

We do not guarantee that the site will operate without interruption or errors. Cardcom's payment page and third-party websites are outside our control. To the extent permitted by law, our liability in connection with an order is limited to the amount actually paid for it, and we are not liable for indirect or consequential loss. Nothing in these terms limits your rights as a consumer under any law, or excludes liability for harm caused intentionally or through gross negligence.

13. Privacy

Information you provide when ordering or contacting us is used to fulfil orders, arrange delivery, provide customer service and meet our legal obligations, and we do not sell it. Details of what we collect, the service providers that process it, cookies, and your rights under the Privacy Protection Law, 5741-1981, including inspecting your information and requesting its correction or deletion, are set out in our Privacy Policy.

14. Changes to these terms

We may update these terms from time to time. The updated version will be published on the site and applies from its publication date. An order already placed is governed by the version in force when it was placed.

15. Governing law and jurisdiction

These terms and every transaction on the site are governed by the laws of the State of Israel. The competent courts in Israel have jurisdiction.
